What is meant by Stat Holidays?

In Canada, statutory holidays are set by the federal government or a government in a province or region. The federal government will decide when you work, so you will get federal holidays instead of local holidays. “General” or “public” holidays are other names for statutory holidays.

A public holiday or statutory holiday is a day set aside to honor an important event. Most workers, whether they work for the government or a business, are eligible to a paid holiday. If an employee works on a public holiday, they are eligible to official holiday pay plus premium pay. They can also choose to get their regular pay for all hours worked on the holiday plus a substitute holiday.

Stat Holiday Pay Eligibility

Legal holidays mean that people can’t work, and most of the time, workers are eligible to pay for these days off. Most workers can get stat holiday pay as long as they follow “the first and last rule” and their workplace is regulated by the Ontario Employment Standards Act.

To get stat holiday pay in Ontario, an employee must have worked their last regularly planned shift before the holiday and their first shift after it, or they must have a good reason for missing both of those days.

It doesn’t matter how long ago suitable people were hired; they can be full-time, part-time, permanent, or on a term contract. Employees don’t get holiday pay if they don’t finish their last regularly scheduled shift before a public holiday or their first regularly scheduled day after a public holiday without a good reason.

Stat Holiday Pay Calculation

To find an employee’s holiday pay in Ontario, you add up their standard hourly wages for the four work weeks before the holiday and multiply that number by twenty. You then add the total amount of vacation pay they are due for those four weeks. For workers who are paid a set wage, this makes it easier to figure out how much statutory holiday pay they need to pay.

On top of the Ontario statutory holiday pay, workers who work on statutory holidays in Ontario can get the extra pay. To figure this out, multiply the number of hours worked by 1.5 times the norm hourly rate. The premium pay for a person is 112 times their base pay. For each hour worked on a public holiday for which they were paid extra, the worker must get 112 times their normal pay.
